By visiting the Site, browsing our playlists, or otherwise using any of our features (collectively, the “Services“), you’re agreeing that your information will be collected, used, and handled the way this policy describes. If that doesn’t sit right with you, we’d rather you know now than later.
Where This Policy Applies
This Privacy Policy covers therightsong.com and nothing beyond it. We link out to artist pages, streaming platforms, ticketing sites, and other corners of the internet because that’s part of connecting you to great music — but once you click through to a third-party site, that site’s own privacy practices take over, and we have no hand in, and no responsibility for, how that other site treats your data.
What We Collect
To keep the Site running and to keep our recommendations sharp, we (sometimes working alongside advertising partners, analytics vendors, and internet service providers) use tools like cookies, pixel tags, and scripts to gather several categories of information about our listeners:
- Personal Information — details that could identify you personally, which you choose to give us, such as your name, email address, mailing address, phone number, or employment details you share when you register for an account, sign up for a newsletter, or contact our team. If you tell us about someone else — say, when sharing a playlist — we may collect that person’s information too.
- Demographic Information — broader, non-identifying details shared by groups of listeners, like zip code, age range, gender, income bracket, education level, marital status, occupation, or musical tastes and interests.
- Behavioral Information — data automatically generated as you use the Site, including which pages and playlists you browse, what songs you click on, your IP address, approximate location, browser and device type, operating system, and the times you visit.
- Third-Party Information — data we receive from outside sources, which may include first- and third-party cookies, anonymous identifiers, email sign-up records, and search terms that led you to us. We don’t control what our advertising, analytics, or social media partners do with their own tracking tools, and we’re not responsible for their independent practices.
- Children’s Information — we do not knowingly gather information from anyone under the age of thirteen (13). If we ever discover that we’ve collected personal information from a child under 13, we’ll delete it from our systems promptly.
Cookies and Similar Technologies
Like most music-loving websites, we use cookies and comparable tracking technologies to remember your preferences, tailor content to your taste, and measure how well our marketing campaigns are performing. Cookies are small files stored on your device that let us recognize you on return visits and keep your experience feeling personal. Some cookies disappear when you close your browser; others stick around until you clear them manually.
How We Put Your Information to Work
We use the information we collect for purposes including the following:
- running, maintaining, and operating the Site;
- improving, personalizing, and expanding what the Site offers;
- carrying out whatever purpose you gave us the information for in the first place;
- studying how listeners use and move through the Site;
- building new features, playlists, tools, and Services;
- communicating with you — directly or via our partners — about customer service, Site updates, and promotions;
- sending you information about products or offers, ours or those of third parties, that might interest a music fan like you;
- letting you know when we change something about the Site;
- delivering the Services you’ve requested;
- responding to your questions and messages;
- spotting and stopping fraudulent or abusive activity; and
- any other purpose you’ve specifically agreed to.
When and With Whom We Share Information
We’re free to share information that doesn’t identify you personally with essentially anyone. When it comes to information that does identify you, we may share it:
- with our affiliated companies and subsidiaries;
- to accomplish the purpose you originally gave it to us for;
- for any use we disclosed to you at the time of collection;
- with third-party marketers who want to promote their own goods or services — unless you’ve opted out of that kind of sharing;
- with a buyer or successor entity if we’re ever part of a merger, acquisition, sale of assets, or similar transaction;
- with vendors, contractors, and service providers who help run our business, all of whom are bound to keep your information confidential and to follow our data-handling standards; and
- whenever you’ve told us it’s okay to.
We’ll also disclose information when the law requires it, when a court or government body compels it, to enforce our agreements, or when we genuinely believe doing so is necessary to protect the safety of The Right Song, our listeners, or the public.
We take our obligations under the CAN-SPAM Act (15 U.S.C. § 7704) seriously and structure our email practices to comply with it. If you’d rather we not share your personally identifiable information with third parties for their own marketing purposes, you can ask us to stop using the contact method described near the end of this policy.
Advertising and Analytics Partners
We work with outside advertising and analytics companies that may place ads for us on other sites, track how those ads perform, and serve their own ads on our Site. These partners may collect information about the sites you’ve visited, the ads you’ve clicked, your IP address, your internet provider, and your browser — sometimes tying that data to personally identifiable information like your name or email so they can deliver targeted advertising by email or through social platforms, and so we can better understand how listeners engage with our content and campaigns.
Your Choices
You’re never required to hand over personal information to browse the Site — you can simply choose not to share it. Most browsers also let you refuse or limit cookies. Keep in mind, though, that some features of the Site may not work as smoothly if you decline to share certain information or block cookies.
Your Rights as a California Resident
Right to Know What We’ve Collected, Shared, or Sold
(a) You may request that we disclose the categories and specific pieces of personal information we’ve collected about you. For purposes of this section, “personal information” does not include: (i) information that’s publicly available from government records; (ii) de-identified or aggregate consumer data; (iii) information the California Consumer Privacy Act (“CCPA“) specifically excludes from its scope; or (iv) personal information already regulated by another applicable privacy law.
(b) To submit a verifiable request for the specific personal information we’ve collected about you, email privacy@therightsong.com with “CCPA Request” in the subject line.
(c) Once we receive a verifiable consumer request, the CCPA requires us to confirm that you’re the person our records pertain to. We may ask you to click a confirmation link sent to your email on file, or to reply to a verification email, before we proceed.
(d) We collect personal information from sources including:
- your direct activity on the Site and your interactions or communications with us, including information you give us to access a product or Service, whether offered by us or by our network partners and advertisers;
- information submitted through contests or promotions we or our partners run;
- surveys, customer support conversations, and general feedback;
- demographic data from analytics providers, such as gender or zip code, not tied to your personal information, plus data from other online or offline sources — including third parties who help us confirm or verify information we’ve already gathered — used to keep our records accurate and to offer you Services likely to interest you; and
- the service providers and other third parties described elsewhere in this policy, including advertisers, ad networks, and technology vendors.
(e) We disclose personal information for purposes including:
- providing the Services you signed up for;
- letting third parties market their own products or services to you;
- delivering information, products, or Services you’ve asked for, or resolving your requests and complaints;
- notifying you about products, Services, events, or news that might interest you;
- improving the Site and how we present our content, through testing, research, and analysis;
- personalizing your experience and delivering relevant offers and content — whether through the Site, third-party platforms, email, or text — with your consent where the law requires it;
- protecting the safety, security, and integrity of the Site, our Services, our databases, and our business generally;
- responding to law enforcement or government requests and complying with legal obligations; and
- evaluating or carrying out a merger, sale, reorganization, or transfer of our business or assets.
(f) We disclose personal information to our service providers as well as to these categories of third parties: our corporate affiliates, data aggregators, advertisers, advertising networks, and third parties connected to products or Services we or they provide to you.
Right to Request Deletion
(a) You have the right to ask us to delete personal information we’ve collected or kept about you within the past twelve (12) months.
(b) Submit a verifiable deletion request by emailing privacy@therightsong.com with “CCPA Request” in the subject line.
(c) Once we’ve verified your request, we’ll tell you what categories of personal information we collected and where it came from.
(d) This policy already discloses why we collect or sell personal information and which categories of third parties receive it.
Right to Opt Out of Sale
You may direct us to stop selling your personal information at any time. If you’re in the middle of requesting a product or Service, this right may be temporarily limited to the extent reasonably needed to complete that request — but you can still tell us to stop all future sales once it’s done.
Right to Non-Discrimination
Exercising any of your CCPA rights won’t result in us treating you worse. We won’t deny you goods or Services, charge you different prices, deny you discounts, provide a lower quality of Service, or suggest that any of that will happen because you exercised your rights.
Authorized Agents
You may have someone else submit a verifiable consumer request on your behalf, provided that person is registered with the California Secretary of State and you’ve authorized them to act for you.
Limits on Requests
You may submit a verifiable access request no more than twice in any twelve (12) month period. Your request must give us enough information to reasonably verify you (or your authorized agent), and must describe what you’re asking for with enough detail that we can understand and act on it. We’re not permitted under the CCPA to hand over personal information if we can’t verify your identity or authority, or confirm the information relates to you. You don’t need to create an account with us to make a request, and any information you give us for verification purposes will be used solely for that purpose.
Response Time and Format
We aim to respond to verifiable consumer requests within forty-five (45) days of receiving them. If we need more time — up to ninety (90) days total — we’ll let you know in writing, by email, why the extension is necessary. We’ll respond in writing by email, our disclosures will cover only the twelve (12) months preceding your request, and if we can’t fulfill part of your request, we’ll explain why. Where we provide data, we’ll do so in a format that’s portable and easy to use.
Updates to This California Notice
We may revise this California-specific section at any time, and any changes take effect the moment we post them. We won’t send you a separate notice beyond updating this page, so check back periodically.
If You’re Visiting From Outside the United States
The Right Song is built for, and intended to be used by, residents of the United States. While we try to respect data protection expectations wherever our listeners come from, our practices are designed around U.S. law. If you’re unsure whether this policy lines up with the privacy laws where you live, please don’t use the Site or give us your personal information.
If you’re located outside the United States and choose to share personal information with us anyway, understand that it will be transferred to, and stored in, the United States — where privacy protections may differ from those in your home country. By doing so, you’re consenting to that transfer and to our use of your information as described in this policy.
Kids and Privacy
We take the privacy of young listeners seriously and don’t knowingly collect information from anyone under thirteen (13) years old. If we learn that we’ve gathered personal information from a child under 13, we’ll delete it as soon as we find out.
Changes to This Policy
We may update this Privacy Policy from time to time, without advance warning, and any revised version becomes effective as of the date we post it. We recommend checking back now and then so you always know how we’re handling your information.
Keeping Your Information Secure
We take reasonable technical, physical, and administrative steps to protect the information we collect, but no system is completely bulletproof, and we can’t promise that unauthorized access, use, or disclosure will never happen. You can help protect yourself by using encryption and other safeguards when sending sensitive information online, and you’re responsible for the security of anything you transmit to us — or view, download, or access — over unsecured or public networks.
